It seems like every few years school districts sue the state, alleging a failure to comply with Texas's constitutional requirement to fund public education. Rumor has it that state school districts are preparing to file suit again.
Senators Ogden and Duncan suggest that the state adopt a property tax to fund schools, replacing some or all local property taxes. It would take a constitutional amendment to authorize such a tax. The senators say it wouldn’t add to taxpayer burden; a statewide property tax would just shift the payment from local to state coffers, allowing distribution of the funds on an equitable basis to all school districts, which is what some believe the constitution requires.
